The former National Security Adviser Michael Flynn is taking the Fifth Amendment in his Russia probe.
In a letter filed with the Senate, Flynn was accused of refusing a request to testify behind closed doors by the Senate Intelligence Committee. Under questioning by Republican Sen. Mark Warner, the former acting attorney general, Flynn invoked the Fifth Amendment and refused to comply.
NSC staffers were “torturing” Flynn by making him say things he didn’t want to admit, the letter notes.
The move came as part of the committee filing for a court document ordering Flynn to testify and giving it the benefit of the doubt.
“Given that you asserted your Fifth Amendment privilege … it is my understanding that you will not consent to further questioning under seal,” Warner wrote in his letter to Flynn on Thursday.
The White House said in a statement that it has been cooperating with investigators and that it is confident they will resolve any issues in the course of the investigations.
Flynn was fired in February after just 24 days on the job for misleading Vice President Mike Pence over his conversations with Kremlin-linked ambassador Sergey Kislyak. He is cooperating with investigators.
Flynn was forced to resign after White House officials discovered he had misled Vice President Mike Pence about their discussions.
Flynn was interviewed by the Senate committee on May 16 ahead of his testimony at the end of May.
At the time the former Trump national security adviser, who now serves as President Trump’s private attorney, was under investigation for his contacts with Russian Ambassador Sergey Kislyak and discussed U.S. sanctions in a December phone call with the Russian ambassador in which he reportedly pleaded “no collusion.”
Trump initially dismissed the investigation into Russian meddling in the 2016 presidential election as “fake news” and said the focus should be on Hillary Clinton’s emails instead. But on March 7 he asked Comey to halt his investigation into the matter. The president has since said that he has an open mind about whether to prosecute Trump or seek a presidential pardon.
